PREAMBLE
These general terms and conditions of sale apply to the collection of contributions for the CAPITOLE train manufacturing project in Z scale carried out by AZAR MODELS during the spring of 2026.
This is a crowdfunding method in which AZAR MODELS offers rewards to contributors in exchange for their contribution to the completion of the project, in this case the production of the French CAPITOLE train in Z scale.
A funding target is set by AZAR MODELS, as well as a collection period. This method of collection works on an all-or-nothing basis: the funds collected are only retained by AZAR MODELS if the funding target has been reached or exceeded at the end of the collection period. Otherwise, the funds are returned to the contributors.
ARTICLE 1 - APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE, ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS, MODIFICATIONS
AZAR MODELS manufactures and/or distributes Z-scale model trains.
These general terms and conditions of sale (GTC) apply exclusively to any contribution made on the website capitole.azar-models.com or during direct sales by AZAR MODELS SARL, hereinafter referred to by its brand name AZAR MODELS, by an internet user/natural person or an association, hereinafter referred to as the Customer.
Consequently, placing an order implies the Customer's full and unreserved acceptance of these GTC, to the exclusion of all other commercial documents such as catalogs, brochures, etc. issued by AZAR MODELS, which are for information purposes only. Any contrary condition put forward by the Customer shall therefore, in the absence of express acceptance, be unenforceable against AZAR MODELS, regardless of when it may have been brought to its attention.
The fact that AZAR MODELS does not invoke any of these general terms and conditions at a given time shall not be interpreted as a waiver of its right to invoke any of these terms and conditions at a later date.
AZAR MODELS reserves the right to modify these general terms and conditions at any time.
ARTICLE 2. ACCEPTANCE OF THE TERMS AND CONDITIONS
The Customer undertakes to read these terms and conditions carefully and to accept them. Any contribution made on the website implies the Customer's unreserved acceptance of these terms and conditions of sale.
These terms and conditions are referenced at the bottom of each page of the website via a link and must be consulted before making a contribution.
ARTICLE 3. OPENING AN ACCOUNT - CONTRIBUTING TO THE WEBSITE
The Customer must be at least 18 years of age to purchase a product and have legal capacity or, if a minor, be able to prove that they have the consent of their legal representatives.
The customer will be asked to provide information to identify themselves by completing the form available on the website and to allow their contribution to be processed by AZAR MODELS. The customer can check the status of their contribution on the website. Deliveries can be tracked using the online tracking tools provided by certain carriers (Colissimo tracking number). Customers may also contact AZAR MODELS at any time, preferably by email at contact@azar-models.com or by telephone, to obtain information on the status of their contribution.
ARTICLE 4. FUNDRAISING PROCESS AND MANAGEMENT OF FUNDS / REFUND
Fundraising will take place over a given period with a start date and an end date in order to reach the amount set for the CAPITOLE project to be realised.
Contributors are invited to participate in this project during this period.
In exchange for contributors' financial participation in the realisation of the CAPITOLE Z-scale train project, AZAR MODELS offers exclusive rewards for the fundraising campaign at preferential prices.
If the financial target is not reached, contributions will be refunded in full within a maximum of 15 days after the end date of the fundraising campaign.
If the fundraising campaign is successful by the end date, the contributions will be validated and retained by AZAR MODELS.
If necessary, the end date may be extended at the discretion of AZAR MODELS to allow as many people as possible to participate in order to reach or exceed the targets.
ARTICLE 5. CONTRIBUTIONS
Contributions are made directly on the capitole.azar-models.com website. However, you can also participate by contacting us directly by phone during office hours or at trade shows/exhibitions.
To contribute to the CAPITOLE project on the website, choose your reward and add it to your cart. Repeat this process for all the products you wish to purchase. To finalize your contribution, click on your shopping cart at the top right of the website and you will see all your items. You can change the quantity or remove any unwanted rewards. By clicking on “Finalize my order,” you continue the process to validate your details by creating your customer account or logging into your account if you are already a customer.
After this identification step, you choose the delivery method and read these Terms and Conditions by checking the box “I have read the Terms and Conditions and I accept them without reservation” accessible by clicking on the link provided.
Finally, you can confirm your contribution by choosing your payment method and making the payment.
Once your payment has been confirmed, you will automatically receive an email with a summary of your contribution.
AZAR MODELS reserves the right to refuse to honor a contribution in the event that the customer has not paid all or part of a previous contribution, or in the event of an outstanding payment dispute.
ARTICLE 6. PRICES
The prices of rewards are displayed in euros, including all taxes (VAT included). Prices do not include delivery costs.
For contributors outside France, prices are displayed with VAT for EU customers or excluding tax for customers outside the EU. To view prices excluding tax, foreign customers must create a customer account with their address in the corresponding country.
The applicable price is the one indicated on the website on the date the contribution is made by the customer.
ARTICLE 7. PROJECT IMPLEMENTATION AND DELIVERY OF REWARDS
As this involves contributing to the implementation of a project to be designed and produced, the contributor accepts that the rewards may not be available immediately.
The provisional project schedule is communicated by AZAR MODELS on the project page with reasonable deadlines in good faith on the date of collection.
AZAR MODELS undertakes to honor the delivery of rewards according to this provisional schedule. This period can generally range from 1 to 2 years, from product design to production, including the manufacture of tools (molds), in accordance with industry practice.
ARTICLE 8. PAYMENT AND COLLECTION
After confirming the delivery method, the Customer finalizes their order using the payment methods offered on our website: credit card, PayPal, check, or bank transfer.
CREDIT CARD: You can pay for your products online by credit card: Visa, MasterCard, or other credit cards. The card number is entered on a secure page hosted by our bank and is therefore not known to AZAR MODELS. The information is encrypted using SSL technology. We use CIC's MONETICO secure payment system. When making a payment, you enter your credit card number, expiration date, and security code (the 3-digit number on the back of your credit card), which are immediately encrypted before being sent to the bank. Payment is made immediately and a confirmation email is sent to you.
• BY PAYPAL: If you have a PayPal account, you can choose PayPal as your payment method. You will be redirected to a secure PayPal payment page to pay your contribution in just a few clicks. Once the payment has been accepted, you will receive a confirmation email with a summary of your contribution.
• BY CHECK: You can pay by check. Check payable to: AZAR MODELS, Mailing address: AZAR MODELS, 2 rue Robert Schuman, 44400 REZE, France
We will wait to receive payment before confirming your participation.
• BY BANK TRANSFER: You can pay by bank transfer. Our bank details will be provided at the end of the participation process along with a summary of your contribution.
Contributors may decide to cancel their contribution before the end of the collection period. In this case, the amount of their contribution will be refunded within 15 days.
Contributors guarantee AZAR MODELS that they have all the necessary authorizations to use their chosen payment method.
AZAR MODELS will take all necessary measures to ensure the security and confidentiality of data transmitted online as part of the online payment process on the website. If the bank refuses to debit a card or other means of payment, the customer must contact AZAR MODELS in order to pay the contribution by any other valid means of payment. In the event that, for any reason whatsoever, opposition, refusal, or other, the transmission of the money owed by the customer proves impossible, the contribution will be automatically canceled.
ARTICLE 9. DELIVERY COSTS AND METHOD, RETURNING PARCELS
As delivery of orders is handled by our carriers (Colissimo, etc.), AZAR MODELS cannot guarantee delivery times. Consequently, the customer cannot hold AZAR MODELS liable for any delay or delivery time longer than that announced.
The current delivery terms and conditions are available on the DELIVERY page of the website capitole.azarmodels.com.
In the event of a package being returned due to an incomplete address or an address entry error by the customer during the contribution process, AZAR MODELS may ask the customer to pay the redelivery costs for the new shipment.
Furthermore, as the period between the collection of contributions and the shipment of contributions is several months, AZAR MODELS reserves the right to adapt the delivery method if necessary, depending on the constraints and possibilities at the time of delivery, and as close as possible to the characteristics and cost of the delivery method initially planned.
ARTICLE 10. RIGHT OF WITHDRAWAL AFTER DELIVERY
In the context of distance selling, you have a legal right of withdrawal (Article L.221-18 of the French Consumer Code). You have fourteen (14) days from receipt of the order to notify us of your decision to return your order or one of the products in your order. You then have a maximum of fourteen (14) days to return the goods to us, without undue delay. Upon receipt of the goods and after checking their condition, if they are approved, we undertake to refund you the total amount of the goods without undue delay and no later than fourteen (14) days after receipt.
Personalized products or products made to order for the customer are not eligible for the right of withdrawal.
To exercise your right of withdrawal, you can send AZAR MODELS the product to be returned within 14 days of receiving the order, accompanied by a letter specifying your contact details, the date, the order number, the date of receipt of the order, and the list of returned products.
The returned product must be unused and in its original packaging, intact and with all accessories included. It must be packaged and protected to ensure maximum protection during return delivery. Please enclose a copy of the purchase invoice. Any product damaged during return or used by the customer cannot be refunded.
Return shipping costs and any customs fees (for packages outside the EU) are the responsibility of the customer and will not be refunded.
ARTICLE 11. WARRANTIES / DEFECTS AND RETURNS
Upon receipt of the order by the customer, the customer has 3 days to notify us of any missing parts or possible defects in a product.
In the event of a damaged package, the customer must take the necessary steps to file a claim with the carrier, noting their comments on the delivery documents and no later than 2 days after delivery.
It should be noted that despite the care taken by AZAR MODELS in manufacturing its products and the cutting-edge technologies used, the assembly and decoration are carried out by hand in our workshops. Consequently, any irregularities or defects in appearance, color, or fit should be considered a testament to the craftsmanship of our workshops in France.
The customer benefits from a legal warranty period of 2 years from the date of delivery and for normal use of the products (compliance with the instructions, reasonable intensity, frequency, and conditions of use).
In any event, AZAR MODELS' liability shall be limited to the value of the product on the date of purchase.
This warranty does not cover wear parts or consumables. Any modification, even partial, to the structure and electronic components of a product or any of its parts will void the warranty.
No product replacement or repair will take place without it being analyzed by AZAR MODELS and provided that this intervention is accepted by AZAR MODELS. The customer undertakes to provide AZAR MODELS in good faith with all the additional information necessary for this analysis.
In the event of a return for after-sales service, the cost of transport for all products and any equipment that needs to be returned to us, whether under warranty or not or for any other reason, will be at the customer's expense. The products will travel at the customer's own risk.
In the event of a defect in a product sold by AZAR MODELS, or part thereof, AZAR MODELS shall in no event be held liable for any direct or indirect damage or loss that may result. In all cases, AZAR MODELS' intervention shall be limited to the repair or replacement of the defective part. In the event that a part claimed to be defective is not defective, the costs incurred in testing it, such as labor, necessary equipment, and transportation costs, shall be billed to the Customer.
ARTICLE 12. LIABILITY
AZAR MODELS shall in no event be held liable for any failure to perform or improper performance of contractual obligations attributable to the customer, in particular when entering their contribution.
AZAR MODELS cannot be held liable, or considered to have failed to comply with these terms and conditions, for any delay or non-performance when the cause of the delay or non-performance is related to a case of force majeure as defined by the jurisprudence of French courts and tribunals.
ARTICLE 13. INTELLECTUAL PROPERTY
All visual and audio elements of the site, including the underlying technology used, are protected by copyright, trademark and/or patent law as intellectual property.
Any total or partial reproduction of the azar-models.com site is strictly prohibited without the written consent of the company.
ARTICLE 14. CONFIDENTIALITY AND PERSONAL DATA
AZAR MODELS collects personal data about its customers on the website.
The data collected is used exclusively to process orders placed on the website and, if the customer has chosen this option, to send them marketing emails, newsletters, promotional offers, and/or information about special sales. Customers can unsubscribe at any time by clicking on the link provided for this purpose at the bottom of each offer received by email. Customer data is kept confidential by the seller in accordance with its declaration to the CNIL under number (pending), for the purposes of the contract, its execution and in compliance with the law.
In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the customer has the right to access, rectify, oppose (for legitimate reasons), and delete their personal data. They may exercise this right by sending an email to: contact@azar-models.com or by sending a letter to AZAR MODELS, 2 rue Robert Schuman, 44400 REZE.
AZAR MODELS is the sole owner of the information collected on our site. Your personal information will not be transmitted, sold, or given to any other company, apart from the company that handles the delivery of your purchases.
We have measures in place to protect the security of your personal information. We use encryption for your sensitive information transmitted online.
We may share information in order to prevent illegal activities, suspected fraud, violations of our terms of use, or when required by law.
By using the site, you consent to this privacy policy.
ARTICLE 15. JURISDICTION IN THE EVENT OF A DISPUTE AND APPLICABLE LAW
This contract is subject to French law. AZAR MODELS cannot be held liable for any damage of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers. AZAR MODELS' liability shall, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the customer has the option, before taking any legal action, to seek an amicable solution, in particular with the help of: a professional association in the sector, a consumer association, or any other advisor of their choice. It is reminded that the search for an amicable solution does not interrupt the “short period” of the legal warranty, nor the duration of the contractual warranty. It is reminded that, as a general rule and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty presupposes that the buyer honors their financial commitments to the seller.
Complaints or disputes will always be received with attentive goodwill, as good faith is always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer shall first contact AZAR MODELS to seek an amicable solution.
Failing this, the Commercial Court of Nantes shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
